GST Registration Cancelled: How to Revoke It

GST2026-10-304 min readBy CGA Tax and Legal Team

Many business owners find out only when a customer says the GSTIN is not active, or when the portal refuses to let them file. If you are searching for "gst registration cancelled how to revoke", the short answer is this: you can apply for revocation on the GST portal, but only within a limited time and usually only after your pending returns and dues are cleared. This article explains the difference between cancellation and suspension, the revocation process, the documents you need, and what to do if the department rejects your application.

Why does the department cancel or suspend GST registration?

Under Section 29 of the CGST Act, the GST officer can cancel a registration on his own, without your request. This is called suo motu cancellation. Before cancelling, the officer normally issues a show cause notice asking why the registration should not be cancelled, and gives you a short time to reply.

The most common reason is non-filing of returns. The law specifically covers a regular taxpayer who has not filed returns for a continuous period of six months, and a composition taxpayer who has not filed for three consecutive tax periods. Other reasons include:

  • Not conducting business from the declared place of business
  • Issuing invoices or bills without actual supply of goods or services
  • Registration obtained by wrong information or fraud
  • Contravening GST provisions in a way the officer considers serious
  • Not starting business within the period allowed after registration

Suspended or cancelled: what is the difference?

Suspension is a temporary step under Rule 21A. The officer may suspend your registration while cancellation proceedings are pending, so the registration is not yet gone but is on hold. Cancellation is final unless you get it revoked.

While a registration is suspended, you should not make taxable supplies or issue tax invoices under that GSTIN. Customers may also be unable to claim input tax credit on your invoices. If you reply to the notice and the officer is satisfied, the proceedings are dropped and the suspension is lifted. If not, the officer passes a cancellation order, and then the revocation route opens.

Always read the notice and order carefully. The wording tells you whether the registration is suspended, cancelled, or only under notice, and from which date it is effective.

GST registration cancelled: how to revoke it, step by step

Revocation is covered by Section 30 of the CGST Act and Rule 23. The key point is the time limit. The application must be made in Form GST REG-21 within 90 days from the date of service of the cancellation order. If you miss this, the Commissioner (or an officer authorised by him) can extend the time by up to 180 more days on sufficient cause, but that is discretionary, so do not plan around it.

In principle, the process runs like this:

  • Log in to the GST portal. A cancelled taxpayer can still log in to apply for revocation.
  • Download and read the cancellation order and the earlier show cause notice, and note the ground and the effective date of cancellation.
  • File all pending returns and clear dues (see the next section).
  • Go to the revocation application option under the registration services, fill in REG-21 with reasons, and upload supporting documents.
  • Sign with DSC or EVC, as applicable to your entity.
  • Track the status. The officer must decide within the time set in the rules. If satisfied, the order of revocation is passed in Form GST REG-22. If not, you may get a notice seeking clarification before any rejection.

Which pending returns and dues should you clear first?

Where cancellation was for non-filing of returns, the department expects you to bring your compliance up to date before revocation is allowed. In principle, you should file all returns due up to the effective date of cancellation, and pay the tax, interest and late fee that arise on them.

Late fee and interest are calculated by the system based on the actual delay, so we are not quoting a figure here. The amount depends on the number of returns, whether they are nil or taxable, and the period involved.

Two practical points matter. First, check every return type, such as GSTR-1 and GSTR-3B for regular taxpayers, or the relevant statements for composition taxpayers. Second, once revoked, check which returns are due for the period after cancellation and file them as required. Missing these can bring the same notice again.

What documents should you keep ready?

The documents depend on the reason for cancellation. A reply that only says "we will file soon" is weak. Your application should show clearly that the default is corrected or the officer's finding was wrong. Usually the following are useful:

  • Copy of the cancellation order and the show cause notice
  • Your reply to the notice, if you filed one, with proof of submission
  • Challans and acknowledgements for pending returns, tax, interest and late fee
  • Proof of the business address, such as rent agreement, electricity bill or ownership document, if the ground was that the premises were not found
  • Sales and purchase invoices, e-way bills or bank statements, if the allegation was about no actual business or bogus billing
  • Authorisation letter or board resolution, and ID of the signatory
  • A short, factual explanation of why the default happened, such as illness, change of address, or the notice going to an old email

What if the revocation application is rejected?

A rejection order is not the end. You can file an appeal under Section 107 before the Appellate Authority, generally within three months from the date the order is communicated to you. A further short period may be condoned for sufficient cause, but that is not guaranteed.

In some situations, such as a cancellation order passed without a proper notice, or without giving reasons, High Courts have been approached by way of writ petitions. Whether this is suitable depends entirely on your facts and the records.

If the time limit for REG-21 has already passed, do not simply give up. You can still consider a request for extension, an appeal against the original cancellation order, or, in the worst case, a fresh registration. A fresh registration brings its own issues, such as a new GSTIN and loss of the old credit position, so get professional advice before choosing.

CGA - Canjain Global Advisors, as an Advocate-cum-CA firm, can review your notice and order, prepare the pending returns, draft the REG-21 application and, if needed, the appeal. The outcome depends on the facts of your case, so share the documents early, since the clock starts from the date of service.

Key takeaways

  • Suo motu cancellation is mostly triggered by non-filing of returns, but can also arise from address or invoice-related findings.
  • Revocation is applied for in Form GST REG-21, within 90 days of service of the cancellation order (extendable by up to 180 days only on sufficient cause), so act quickly.
  • File pending returns up to the date of cancellation and pay tax, interest and late fee before applying.
  • Keep the order, notice, reply, challans and proof of address ready; the supporting documents depend on the ground of cancellation.
  • If revocation is rejected, an appeal under Section 107 is generally available within three months.

Frequently asked questions

What is the time limit to apply for revocation of GST cancellation?

The application in Form GST REG-21 should be filed within 90 days from the date of service of the cancellation order. On sufficient cause, the Commissioner can extend this by up to 180 more days, but that is discretionary. It is safer to apply well within the 90 days.

Can I revoke GST cancellation without filing pending returns?

Where cancellation was due to non-filing of returns, you should first file the returns due up to the effective date of cancellation and pay tax, interest and late fee. Without this, the application is likely to face objections or rejection.

Will I get the same GSTIN after revocation?

Yes. Revocation restores the existing registration, so the same GSTIN becomes active again. This is one reason revocation is usually better than taking a fresh registration.

Can I issue invoices if my GST registration is suspended?

No. During suspension you should not make taxable supplies or issue tax invoices under that GSTIN. Get the notice reviewed and reply on time so the suspension can be lifted.

What if I never received the show cause notice?

Notices are served on the portal and to the registered email or mobile, so check the portal's additional notices and orders section. If you genuinely did not get a proper notice, mention it in your revocation application or appeal, with supporting facts. Whether it helps depends on the record.
